Nevada Court Order Gives Green Light to NML Capital to Seek Information About Funds Embezzled from Argentina by Lazaro Baez
ATFA's Robert J. Shapiro and Lead Counsel Robert A. Cohen offer details of Nevada court order to allow discovery into money laundering by shell corporations operated by Kirchner confidant Báez

ATFA Co-chair Robert J. Shapiro and NML Capital Senior Legal Counsel and Dechert Partner Robert A. Cohen will discuss the U.S. District Court of Nevada's August 11th order in the case of NML Capital Ltd. v. Republic of Argentina which grants NML discovery into the workings of 123 shell corporations allegedly used to launder $65 million of embezzled funds by the government of Argentina into offshore Seychelles bank accounts on a media teleconference, Thursday, August 14, 3 p.m. EDT /4 p.m. ART.

The Court order follows an exposé pointing to allegations that Presidents Nestor and Cristina F. Kirchner plotted with construction baron Lázaro Báez to launder tens of millions in funds earmarked for public works through a network of Nevada-based shell corporations controlled by Báez.  The NML proceeding builds upon an early investigation by Argentine prosecutor José María Campagnoli, who was later suspended by judicial authorities.

On June 16, the U.S. Supreme Court affirmed that Argentina is not protected from the discovery process by the Foreign Sovereign Immunities Act.
