ist das nicht unser neuer Mister Euro (Nachfolge Junker) der das Enteignungsdecree unterzeichnet hat....// ist das jetzt der neue europäische Weg mit den Schulden und der Schuldenkrise fertig zu werden....


Decree by the Minister of Finance of February 1, 2013 regarding the expropriation of
securities and capital components of SNS REAAL NV and SNS Bank NV in connection with
the stability of the financial system, and to take immediate measures with regard to SNS
REAAL NV
Decree pursuant to Sections 6:1(1), 6:2(1), (4) and (5), and 6:4(1) and (2) of the Financial
Supervision Act (Wet op het financieel toezicht)
The Minister of Finance, acting in agreement with the Prime Minister, Minister of General Affairs;
Having regard to Sections 6:1(1), 6:2(1), (4) and (5), and 6:4(1) and (2) of the Financial
Supervision Act;
Having consulted De Nederlandsche Bank;
DECREES as follows:





This Decree shall also be announced in the Government Gazette (Staatscourant).
The Minister of Finance,
J.R.V.A. Dijsselbloem
Any interested party may file objections against this Decree, within 10 days of the date of
publication of this Decree, with the Council of State (Raad van State), Administrative Law section.

  1. Uns bleibt nur der Rechtsweg, über das BIT, mit der Sammelklage zum ICSID in Washington... Hier stehen die Chancen sehr gut! Siehe auch Gutachten der SDK... in Europa ist jegliche Rechtsstaatlichkeit am Ende! Hier wird nur noch enteignet...

  2. das ist zu Vergleichen mit der Enteignung der HRE-Aktionäre und völlig anders gelagert als Griechenland.

    Die SNS ist, wie es die HRE oder etwa auch Lehman waren, eine private Bank, deren Eigenkapital durch Verluste aus ihrem Kreditgeschäft aufgezehrt wurde. Die Aktien sind schlicht nichts mehr wert. Wäre das eine Firma wie Arcandor, man würde sie pleite gehen lassen und die Aktionäre würden leer aussteigen. So wie auch bei Lehman geschehen.

    Die Niederlande "retten" nun die SNS so wie Deutschland die HRE gerettet hat, aber wieso soll man den Aktionären jetzt was zahlen? Senior Bonds werden dagegen weiterhin bedient:

    "Last week the Dutch government announced the full expropriation of SNS Reaal, the 4th largest Dutch bank and decided to write-off shareholders and junior bondholders while senior bondholders where left untouched."

    das weiß man als Anleger ja auch vorher: "In the case of default, creditors with subordinated debt wouldn't get paid out until after the senior debtholders were paid in full. Therefore, subordinated debt is more risky than unsubordinated debt. "

    großer Unterschied zu Griechenland, wo a) die Bedingungen nachträglich geändert wurden und b) willkürlich zwischen voller Rückzahlung und Enteignung bei gleichwertigen Bondklassen, ja sogar innerhalb gleicher Bonds geteilt wurde.
