Vergleich Päambel BIT ARG-IT (ICSID ARB/07/05) und BIT GRI-DE von 1961/63

ICSID kommt zu dem Schluss, dass argentinische Staatsanleihen dem Schutz des BIT ARG-IT unterliegen!
 
 Das wird also beim GRI-DE-BIT nicht anders sein. !!

DIE BUNDESREPUBLIK DEUTSCHLAND und DAS KÖNIGREICH GRIECHENLAND

IN DEM WUNSCH, die wirtschaftliche Zusammen­arbeit zwischen beiden Vertragsstaaten zu vertiefen, in dem Bestreben, günstige Bedingungen für Kapital­anlagen von Staatsangehörigen und Gesellschaften des einen Verlragsstaates im Hoheitsgebiet des anderen Vertragsstaates zu schaffen, und
IN DER ERKENNTNIS, daß ein vertraglicher Schutz dieser Kapitalanlagen geeignet ist, die private wirt­schaftliche Initiative zu beleben und den Wohlstand beider Völker zu mehren,

    "The most notable feature of the decision is the Tribunal's approach to the concept of an "investment". Argentina had argued that the claimant's interests lacked the necessary characteristics to count as an "investment" so as to permit a treaty claim. It relied on the classic summary of these criteria as set out in the Salini case(3), and observed that the individual claimants' claims failed to meet many of these criteria. The Tribunal held that the Salini criteria "should not … create a limit" on the types of claims that can be brought. The definition of "investment" had deliberately been left vague in investment treaties to allow case-by-case consideration, and it was open to the Tribunal to look at the "economic reality of [the aggregate of] these claims" in doing so."
    Die Argumentation deckt sich mit dem, was Alexander Szodruch 2007 als "Tendenz" der ICSID-Entscheidungen herausgearbeitet hat. Dass die ICSID bei der Entscheidung, ob die zu entscheidende Investition vom BIT gedeckt sei, den Aspekt berücksichtige dass der Claim unter völkerrechtlichen Standpunkten angegriffen worden ist. Es gibt auch gegenteilige Meinungen, die verlangen, die Schiedsgerichte sollten den Begrif der Direkinvestition wieder in den Focus nehmen.
    Wenn das Kriterium die völkerrechtliche Deckung ist, stellt sich auch gleich die Frage, ob die Schiedsgerichte der korrekte Weg sind. Es dauert wohl genau so lange und ist genauso teuer (oder teurer) wie ein normales Verfahren bis zum IGH/EUGH und ist nicht rechtlich angreifbar.
    Oder sehe ich das falsch?

  2. Ich freue mich auf dein blog gestossen zu sein. Bin leider opfer von griechenlandanleihen. welche kompetente rechtsanwaltskanzlei kann mich juristisch vor dem icsid vertreten (lebe in griechenland und habe die deutsche staatsangehoerigkeit. wuerde mich ueber eine Antwort freuen.
